Nathan (7) wins against the Immigration Appeals Board

The Immigration Appeals Board (UNE) denied Nathan and his parents asylum in Norway back in April 2012. Tuesday, the District Court concluded that UNE's verdict in the case was invalid.

The court did not find the Immigration Appeals Board's (UNE) decision to return the family to their home country, Ethiopia, enforceable. Unless UNE decides to appeal the case, the board's conclusion from last year will not be considered final, and the family can stay in Norway.

The District Court's verdict states that the child's best interest had not been properly evaluated by UNE, and that Nathan could possibly risk trauma if he were to be returned to his parents' home country, Ethiopia, while UNE's decision is being processed in court.

Nathan was born in Norway, and has lived here his whole life.

Although the District Court's conclusion was in Nathan's favor, it also ruled that the family has stayed in Norway illegally.

The family claimed to have acted in good faith, but the court thinks that the family was well aware that their applications had been denied and they were ordered to leave the country.
